If you’re dealing with an insurance claim that feels stuck maybe it’s underpaid, delayed, or denied — you’ve probably heard of both public adjusters and property insurance attorneys. But what’s the difference? And when do you need one versus the other?
Public Adjuster (PA): The Claim Preparer
A public adjuster is a licensed professional who helps you prepare, estimate, and negotiate your insurance claim. They know how to document your damage, write a detailed estimate (usually in Xactimate), and present it to the insurance company. Many PAs charge a percentage of the total recovery, and they’re often the first line of defense when a claim isn’t going smoothly.
What they can do:
- Write and submit your claim
- Communicate with the carrier’s adjusters
- Push for supplements and higher payment
What they can’t do: - File lawsuits
- Send legal demands or CRNs
- Enforce payment in court
Property Insurance Attorney: The Enforcer
An attorney steps in when the insurance company stops playing fair — denying claims outright, ignoring valid estimates, or simply dragging their feet. We use California law to compel the carrier to pay, whether through negotiation, litigation, or appraisal.
What we can do:
- File lawsuits or legal demands
- Enforce policy rights (RCV, ALE, O&L, etc.)
- Represent you in bad faith or breach of contract claims
Do You Need Both?
Often, yes. We work with many excellent public adjusters who build a solid foundation for the claim. When that foundation isn’t enough to get paid we step in and push it across the finish line.
